Who is running the offer? The “Promoter” is Metagenics (Aust) Pty Ltd (ABN 78 113 937 572), 741 Nudgee Rd NORTHGATE QLD 4013
AUSTRALIA (‘Metagenics’).

When will the offer start and end? The offer starts at 12.01am (AEDT) on 20/03/2019 and ends at 11.59pm (AEDT) on 19/5/2019 (the Offer Period).
Who can enter? Only Australian residents aged 18 or over can enter.
Who can't enter? Directors, officers, management and employees of:
(a) the Promoter; or
(b) the agencies or companies or participating Outlets associated with this offer,
and their immediate families, can't enter.

Where will the offer run? This offer is running in all Australian pharmacies, where Ethical Nutrients MEGAZORB Mega Magnesium Night 126g is stocked.
Do I need to buy anything to enter? Yes. During the Offer Period, you must purchase Ethical Nutrients MEGAZORB Mega Magnesium Night 126g, either in store or online. You must retain your receipt (proof of purchase) to validate your entry. The RPP for this product is $44.50 including GST.
Entry instructions After you have made a qualified and verified purchase, you must enter the offer during 1st of April and 19th of May 2019. 

Please enter online, visit www.magnightgiftcard.com.au (Website) and;
• fill out and submit the online entry form, with the details of your purchase as required and providing all other requested information;
• Follow prompts & upload a valid till receipt (POP – Proof of Purchase);

• Choose from the dropdown menu which retailer you purchased this product from. If the store you purchased this product from is not on the list, please select ‘other’. 
Purchase receipt(s) must clearly identify the Outlet of purchase, the product purchased (which must be a Qualifying Purchase), the unique code or order number, and the date of purchase (which must be during the Offer Period before you submitted your entry).
A receipt showing a Qualifying Purchase can only be used to make 1 entry, regardless of how many Qualifying Purchases are shown on that receipt.

What can I get? An approved Qualifying Purchase will receive a $20 Gift With Purchase (CashBack) Voucher by choosing from a Virtual Visa or Physical Visa product.
How many times can I enter? Each consumer is eligible to one entry per purchase of Mega Magnesium Night. Each receipt (or Proof of Purchase) will only be validated once.
How and when will I be informed? Once your claim has been validated, you will be informed in via email within one week of the submission of the Qualifying Purchase via the website.
Must I keep anything to verify my entry? You must keep the original itemised purchase receipt(s) for all entries as proof of purchase in order to validate your claim. Purchase receipt(s) must be identical to the image uploaded by you with your entry. The Promoter will not qualify entries without a proof of purchase, in which case a Voucher will not be rewarded. If, in an instance, the Promoter's opinion, you have shared any receipt(s) with another person, your entries will be invalid, and you will lose any right to a Virtual or physical Visa Voucher product.
When must I make a claim? All claims must be submitted by 11.59pm (AEDT) on 19/5/2019

Entry

Your entry must be received during the Offer Period. Your entry is deemed to be received only when received by the Promoter’s database. If you return a Qualifying Purchase your entry may be deemed invalid at the Promoter's discretion (unless product is defective). You will receive a return online message confirming your entry. The Promoter is not liable for any problems with communications networks. You are responsible for your own costs associated with entering. If you enter using automatically generated entries or multiple aliases you may be disqualified.

Visa gift card Vouchers

The Virtual or physical Visa Vouchers are subject to the Voucher supplier's conditions.

The $20 Gift With Purchase (CashBack) Virtual Voucher is a eGift delivered as link sent by valid email supplied at time of claim or Physical Gift Card and are to the name and address details supplied at time of claim and sent upon approval of claim and subjective to Visa Gift Card terms and conditions.

General

  1. If you or your entry are deemed by the Promoter to breach these Terms and Conditions, your entry (or at the Promoter's discretion, all of your entries) may be discarded. The Promoter may, at any time, require you to produce documentation to establish to the Promoter's satisfaction the validity of your entries (including documentation establishing your identity, age, place of residence and place of employment). Failure by the Promoter to enforce any of its rights at any stage does not waive those rights.
  2. You must not:
    1. tamper with the entry process;
    2. engage in any conduct that may jeopardise the fair and proper conduct of the offer;
    3. act in a disruptive, annoying, threatening, abusive or harassing manner;
    4. do anything that may diminish the good name or reputation of the Promoter or any of its related entities or of the agencies or companies associated with this offer;
    5. breach any law; or
    6. behave in a way that is otherwise inappropriate.
  3. The Promoter is not liable for entries, of Virtual or physical Visa product claims or correspondence that are misplaced, misdirected, delayed, lost, incomplete, illegible or incorrectly submitted.
  4. The Promoter’s decision in connection with all aspects of this offer is final.
  5. Virtual or Physical Visa Vouchers cannot be transferred or exchanged nor redeemed for cash. The Virtual or Physical Visa Vouchers values are correct as at the date of preparing these Terms and Conditions and include any applicable GST. The Promoter is not responsible for any change in Virtual or Physical Visa Vouchers value. You agree that if a Virtual or Physical Visa Vouchers (or element of the Visa Voucher) is unavailable for any reason the Promoter may provide another item of equal or higher value, subject to any necessary approval by the state/territory gaming authorities.
  6. If this offer cannot run as planned for any reason beyond the Promoter's control, for example due to software, hardware or communications issues, unauthorised intervention, tampering, fraud or technical failure, the Promoter may end, change, suspend or cancel the offer or disqualify affected entries/entrants, subject to any necessary approval by the state/territory gaming authorities.
  7. The Promoter is not responsible for any tax implications arising from you winning a Virtual or Physical Visa Vouchers. You should seek independent financial advice. If for GST purposes this offer results in any supply being made for non-monetary consideration, you must follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.
  8. If this promotion is interfered with in any way or is not capable of being conducted as anticipated by the Promoter due to any cause beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any individual; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.

Liability

  1. Nothing in these Terms and Conditions restricts, excludes or modifies any consumer rights under any statute including the Offer and Consumer Act 2010 (Cth).
  2. Subject to the previous paragraph, the Promoter and the agencies and companies associated with this offer are not liable (including in negligence) for any loss (including indirect, special or consequential loss or loss of profits), expense, damage, personal injury, illness or death suffered in connection with this offer or any Virtual or Physical Visa Vouchers, except for any liability which under statute cannot be excluded (in which case that liability is limited to the greatest extent allowed by law).
  3. Without limiting the previous paragraph, the Promoter and the agencies and companies associated with this offer are not liable for any loss of, damage to or delay in delivery of Virtual or Physical Visa Vouchers and will only be delivered to addresses in Australia.
  4. The Promoter may communicate or advertise this offer using SMS or Email.
  5. Collection and use of your personal information
  6. The information you provide will be used by the Promoter for the purpose of conducting this offer. The Promoter may collect your personal information (including through its contractors or agents) or disclose your personal information to its contractors and agents to assist in conducting this offer or communicating with you. By entering this offer, you consent to the storage of your personal information on the promoter’s database and the Promoter may use this information for future offer and marketing purposes regarding its products, including contacting you via electronic messaging. If you have marked the “opt-in” box on the entry form relating to Metagenics using your personal information for future marketing purposes, you consent to Metagenics keeping your personal information on its database and contacting you by electronic messaging.
